About the Data Protection Officer

When am I required to appoint a Data Protection Officer?

In the EU a DPO is required when the company‘s core activities monitor data subjects on a large scale or include processing sensitive data. This could include companies in healthcare, pharmaceuticals, social services, surveillance.

How much is a Data Protection Officer?

It depends… Costs vary depending on the size of the company and the scope of support required. Compared to an internal DPO, the external solution is generally significantly more cost-effective – with no training or absence-related costs.

What's the difference between an internal and an external DPO?

Internally, an employee would need to undergo extensive initial as well as ongoing training – and would still lack experience in the beginning. An external DPO brings specialised expertise, is independent, immediately deployable, and reliably available. Most importantly: they bring a wealth of practical experience in how things are done elsewhere.

Can I simply switch my existing DPO?

Yes. Switching is possible and straightforward on our end. We manage the handover and ensure there are no gaps in coverage.

What does working with us look like in practice?

After an initial introductory meeting, we’ll start with a data protection project in which we analyse your current data protection situation, document it together in foxondo, and identify any areas requiring action. We then support you with the implementation step by step – personally, practically, as your partner.

How often will we be in contact?

That depends on your needs. We plan a set number of hours per month, covering all enquiries from your side as well as any regular check-in meetings. Beyond that, we are always available for questions, incidents, or changes. In addition, you will receive an annual data protection report outlining all activities undertaken.

What happens in the event of a data breach?

Data breaches generally need to be reported to the supervisory authority within 72 hours. We support you immediately – from assessing the incident to filing the correct report.

Common Data Protection Questions

No, consent is not always required when processing personal data. There are other legal bases – such as performance of a contract or a balancing of legitimate interests. fox-on will show you practical approaches.

What needs to be considered when working with service providers?

In many cases, a so-called data processing agreement is required when service providers process personal data. fox-on has templates for such contracts and checks that all legal requirements are included.

Am I allowed to send marketing communications?

Advertising is everywhere these days – indispensable for businesses, but sometimes unwanted from a customer’s perspective. There are several pitfalls here. Marketing sent via post is generally permitted. Advertising by telephone, or email is more complex. Do I have to disclose a cyberattack or other data breach?

If personal data was not adequately protected, the data protection supervisory authority often needs to be informed – within 72 hours. In serious cases, data subjects may also need to be notified. fox-on advises and supports you quickly and practically.

How does data protection work across affiliated companies

The corporate group may feel like one big family, but it is not the case from a data protection perspective. Every transfer of personal data – even within a corporate group – requires appropriate legal bases. It’s not rocket science, but it does need to be addressed.
